Use of the Service, other than as a Visitor who must be at least 18 years of age, requires you to create an account at any one of our four sites, hypocrite.com, hypocrites.com beaver.com or hypocritters.com or other authorized signup stations on other web sites. To register on our sites just click on the "Register" link where you will be asked to provide a unique User Name, your real first and last names and a working email which belongs to you. You will be provided by email a password which you may choose to change for your convenience. At this time you may have multiple accounts on multiple sites but must have different working emails for each account. You may never use another's account without permission. When you create an account you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify the Company immediately of any breach of security or unauthorized use of your account. If you suspect unauthorized use, plese immediately close out your account and establish a new one. You may be liable to a third party for any losses caused by any unauthorized use of your account on the Site, and pursuant to the indemnification provision set forth herein, you hereby agree to indemnify and hold the Company harmless against any such losses caused by the unauthorized use of your account. b. Termination of Account. This Limitation of Liability and Indemnify will survive these Terms of Use and your use of the Hypocrites Site.11. Eligibility. This Site is not intended for use by persons under the age of eighteen. Individuals who are under the age of eighteen are expressly prohibited from submitting to the Site or posting to the Site any personally identifiable information. The Company intends to comply with all applicable laws and regulations which require the consent of a parent or guardian in order to collect personally identifiable information from children. Each User is therefore required to report any non-compliance of which such User has knowledge immediately to the Company via electronic correspondence to __admin@beaver.com_____.12. Miscellaneous. Failure by the Company to enforce any provision(s) of this Agreement shall not be construed as a waiver of any provision or right. This Agreement, and all other aspects of use of the Site, shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws rules. All claims and disputes arising out of this Agreement, the Privacy Policy or the Policies, or use of the Site, other than action for a specific performance or an injunctive relief brought by the Company, shall be exclusively brought in the federal, state or local courts located in Denver, Colorado; and, with regard to such claims and disputes, Users hereby irrevocably (i) submit to the exercise of personal jurisdiction over them by these courts, and (ii) waive any jurisdictional, venue or inconvenient forum objections to such courts. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible, and the remaining provisions shall remain in full force and effect. The User may not assign, transfer, or otherwise any rights and licenses granted hereunder; provided that, the Company may assign any of the foregoing without notice or prior written consent. This Agreement shall inure to the benefit of the Company, its successors and assigns. The Agreements and any other legal notices published by the Company on the Site, shall constitute the entire agreement between you and the Company regarding the use of the Hypocrites Site.
